At this most basic level of
service, we provide assistance in the
preparation of the forms and other legal documents and guidance
in the meeting of procedural requirements for what would otherwise be
called a Pro Se
divorce. An initial consultation with an attorney is available.
Pro
Se is a Latin term meaning “for yourself”.
Just as you have a right to have an attorney
represent you, you have a right to act on your own behalf—to act pro se—when
dealing with the Courts.
When a lawyer represents you, he or she is acting in
your place, as your legal representative, with the people on the other
side of the case, with the Court or with third parties. But you
can also engage a lawyer to only advise and assist you with the
procedural and substantive aspects of a legal matter while you deal
with others.
Sometimes it is best to have your lawyer stand in
the front line for you.
Sometimes it is best for you to handle the matter yourself.
The decision whether to handle a matter pro se—or to be
represented by a lawyer - is always a personal decision, unique
to the individual and the case.
The program provides:
- Consultation
- Advice
- Procedural assistance
- Document production
- General guidance for those who wish to handle a family
law matter without having an attorney acting as their legal
representative.
Our services include:
- All the forms needed for your divorce, personally and
professionally prepared for you, ready for signatures.
- Helpful instructions for filing with the Court.
- Supportive services to enable you to use the legal system
competently and without fear.
What is not included:
- We will not go to Court for you
- We do not have contact directly with the Court
- We will not negotiate for you with any adverse party or with
any third party to your action.
Family law matters are very important to you
and to those you love. While we do not encourage conflict, we
also do not encourage compromise just to avoid
confrontation. Each person must decide individually what is right
for them.
To decide whether pro se is right for you, you must
balance all the factors and be in agreement on:
- Property division
- Payment of debts
- Custody of minor children
- Child support
- Maintenance or alimony
When these issues are agreed, the documents
must be signed by both husband and wife, then filed with the
Court. We can prepare the documentation according to your
instruction and guide you through the Court system.
